RENT AGREEMENT / LEASE DEED

This Lease Deed made at Gurugram on this ...th Day of .......... 2018

 between

Mr..................................S/o Mr. ................................. R/o H.no. ............................................ (hereinafter called the “Lessor”), which expression shall unless excluded by or repugnant to the context include his/her/their heirs, executors, administrators, representatives and assigns of the One Part.

AND

Mr..................................S/o Mr. ................................. R/o H.no. ............................................ (hereinafter called the “LESSEE”), which expression shall unless repugnant to the context or meaning there of include his/her, their successors and assigns) of the other Part, WITNESSETH as follows :-

In consideration of the rent hereinafter reserved and all the covenants and conditions hereinafter contained to be observed and performed on the part of the LESSEE the LESSOR does hereby grant demised by way of lease premises Shop/Flat no. .......................................... (“Demised Premises”) of which the LESSOR is entitled in law to execute this Deed together with this appurtenant land/space, the right to make use of entrances, passage, staircase landing and other easements, belonging and pertaining to the said premises unto and to the use of the LESSEE for 11 months.

 

Lease Commencing from ......................  by paying unto the LESSOR during said period a Rent of Rs. 0000000/-(Rupees: ................................... only) per month payable in advance, inclusive for hire charge of the fitting and fixtures in the premises, subject to the following conditions :-

THE LESSEE HEREBY CONVENANTS WITH THE LESSOR AS FOLLOWS:-

  1. That the LESSEE shall pay to the LESSOR the said monthly rent Rs.000000/- (Rupees: ............................... only) taxes will additional if any  by Cash/Cheque before 7th Day of each English Calendar Month.

 

  1. That the LESSEE has paid 2 months Security deposit of Rs. 00000/- (Rupees. .......................... only) vide Cheque No.-……….. Dated: ……….. of ……………………… Bank Ltd. as interest Free Security Deposit to be refunded at the time of Termination of the Lease or vacation on the Said Premise after deducting outstanding dues, if any.

 

  1. That subject to the LESSOR convents the LESSEE shall keep the interior of the demised premises in good order and condition (reasonable wear and tear expected).

 

  1. That the LESSEE shall use demised premises for Legal Commercial purpose only and shall pay for consumption of electricity charges (According to Current Meter )and Water Charges as per the Meter Reading.

 

  1. That the LESSEE shall not carry out any structural additions or alterations to the Demised Premises.

 

  1. That the LESSEE shall not Sub-let. Assign or otherwise part with possession of the demised premises without the consent of the LESSOR in writing.

 

  1. That the LESSEE shall deliver the demised premises to the LESSOR on the expiration or earlier determination of the Lease together with the LESSOR’s fitting and fixtures, if any in such condition herein contained.

THE LESSOR HEREBY CONVENANTS WITH THE LESSEE AS FOLLOWS:-

  1. That the LESSEE shall peacefully and quietly hold and enjoy the demised premises during the lease period(s) without any interruption or disturbances by the LESSOR or any person rightfully claiming under in trust for him/her.

 

  1. The LESSOR shall affect all major repairs such as leakage in electricity, sanitary fittings, water pipes or cracks etc. As his own cost immediately upon such defects are notified to him by the LESSEE. Minor repair cleaning of sewer line shall be responsibility of lessee.

 

  1. That the LESSEE shall pay all govt. taxes, rates, license fees and charges of whatever character assessed, levied, charges and imposed by any lawful authority in respect of the demised premises.

 

  1. That the LESSOR represents and warrants that he is fully entitles to execute this Lease Deed and that he/she will hold the LESSEE free and harmless of any demands, claims, actions or Proceeding by others in respect of quiet possession by the demised premises.

 

 

 

 

IT IS HEREBY MUTUALLY AGREED AS FOLLOWS:

  1. That the LESSEE shall permit the LESSOR his/her agent(s) etc. to enter upon the leased premises for inspection and carrying out repairs etc. In reasonable time as when necessary.

 

  1. The lessee may terminate this agreement after giving 2(Two) months notice in writing to the Lessor after 6 (Six) Months Lock in Period. The Lessor shall also have the right to terminate this lease agreement by giving 2(Two) months notice in writing to the Lessor after 6 (Six) Months Lock in Period.

 

  1. That there will be a Lock-in-period for Six months with mutual consent of both parties. If the lessee vacates the premises before eighteen months, the remaining period rent shall be paid by the lessee to the Lessor or the security will be forfeited. Rent will be increased 7% after 11 months Completion and Later 10% on current rent after every 11 Months.

 

  1. That up to the expiry of the lease period of 11 months the LESSEE shall vacate the demise premise and handover/vacate and peaceful possession to the LESSOR without any delay. With the mutual consent of both the parties the lease can be extended for further period.

 

  1. That in the event of dispute, if any, the Lease deed is subject to the Jurisdiction of the Courts in Gurugram, Haryana.
